I understand and am aware that strength, flexibility and aerobic exercise, including the use of equipment, is a potentially hazardous activity. I have been advised and understand that fitness activities, including but not limited to pilates, barre exercises and suspension fitness and using suspension equipment, dumbbells and all other equipment, including but not limited to yoga mats, fitballs and TRX suspension system, involve a risk of injury, especially to people who have pre-existing injuries, illness or medical disabilities.
I understand and am aware that these exercises described herein will be conducted without shoes and barefoot. I am voluntarily participating in these activities and using all the equipment, suspension equipment and machinery with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or even death. I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation or use of all equipment, suspension equipment and machinery. I do hereby acknowledge that I have been informed that a medical evaluation is advisable before participation in an exercise/fitness activity or in the use of all exercise equipment, suspension equipment, dumbbells and machinery. I acknowledge that I have either had a physical examination and have been given my physician’s permission to participate, or that I have decided to participate in activity and use of all equipment, suspension equipment, dumbbells and machinery without the approval of my physician and do hereby assume all responsibility for my participation and activities, and utilization of all equipment and machinery in my activities. I understand it was my responsibility to fully inform TRUE40 AUBURN LLC of any physical condition or disability which would prevent or limit my participation in an exercise or physical conditioning program. I understand that True40 nor its officers, shareholders, its franchisor, employees, including but not limited to coaches, trainers, teachers, sales officers, trainees and contractors are engaged in diagnosing or treating medical disease or deficiencies.
I expressly assume all risks of my participation in all exercise programs conducted by TRUE40 AUBURN LLC and hereby waive, release and forever discharge any claim which might otherwise be brought against True40, its officers, shareholders and employees, including but not limited to coaches, trainers, teachers, sales officers, trainees and contractors, as a result of injuries resulting from or relating to my participation in all exercise programs, conditioning programs, in any activities, or use of all equipment, suspension equipment or machinery. I expressly permit and allow True40 and TRUE40 AUBURN LLC, its officers, shareholders, franchisor and employees, including but not limited to coaches, trainers teachers, sales officers, trainees and contractors, to use my image publicly, either photographically or videographically, images or movies, in such avenues as the True40 website, on social media, in advertising and any and all forms of marketing as seen fit by TRUE40 AUBURN LLC officers, shareholders, franchisor and employees, including but not limited to coaches, trainers teachers, sales officers, trainees and contractors.
I understand that TRUE40 AUBURN LLC nor its franchisor are not responsible for any articles lost, stolen or damaged in or about the studio. I understand that the storage cubbies are opened to the public and do not have a lock.
Studio Policies:
1. Since we are a reservation-based studio, we ask that you cancel your class reservation at least 2 hours before the scheduled class time. No-shows or canceling within the 2-hour window will result in a $15 fee, or a deduction from your class pack. If you're on a waitlist, it means that you plan to come to class if a spot opens up all the way up to one hour before class. Late cancel and no-show fees will apply if you're added to class from the waitlist within the time period above and don't show up.
2. Clients are required to wear sticky socks to keep studio environment clean. You can bring your own sticky socks to the studio or they are available for purchase once you arrive.
3. When you purchase a package, you are agreeing to pay the listed amount for the duration of the package, unless extreme circumstances occur.
4. Your email is safely secure with us. You will receive reminders, notifications, our newsletter, and promotion. You have the option to unsubscribe at any time.
5. For retail purchases, we offer exchanges and returns for store credit as long as we still have the item in stock, and item is in good condition. We do not offer refunds or returns on class packs or memberships.
6. There are no phones allowed in the studio during class. If you're expecting a call, leave your phone at the front desk and an employee can come get you during class.
7. We require all clients to put a card on file at the time of first visit.

I release and hold harmless True40, True40 Corporate Studios LLC and its owners, directors, officers, advisors, employees, agents, instructors, volunteers, childcare workers and all other persons or entities acting for them from any and all claims, demands, suits, costs and charges, in connection with or arising out of True40 Corporate Studios LLC childcare service, including but not limited to, personal injury, bodily harm, injury or property damage occurring while the below child/children is/are in their care at True40 Corporate Studios LLC.
I understand that if my child should become inconsolable (crying for 10 minutes) during the class session, I am responsible to leave class and attend to my child.
I understand that I must reserve a spot for my child/each child at least 2 hours prior to class. If I have to cancel within that window, I understand I will be charged a $15 fee to compensate staff.
I will be responsible to feed my child and have my child use the restroom prior to start of class time to the best of my abilities.
I understand that if my child is on the property of the True40 and True40 Corporate Studios LLC, I must remain on the property at all times.
I understand that I am responsible for communicating any allergies and/or special instructions to the team at True40 Corporate Studios.

I have been advised and understand that fitness activities, including but not limited to Pilates, barre exercises, and suspension fitness, and using suspension equipment, dumbbells, and all other equipment I may use or have access to (including but not limited to yoga mats, fit balls, and TRX suspension systems) involve a risk of injury, especially to people who have pre-existing injuries, illness, or medical disabilities. I understand and am aware that these exercises described herein will be conducted without shoes (sticky/grippy socks required). I am voluntarily participating in these activities and using all the equipment, suspension equipment, and machinery with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or even death.

I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent or limit my participation or use of all equipment, suspension equipment, and machinery. I understand it is my responsibility to fully inform Rocket City Motion LLC d/b/a True40 Huntsville (“True40 Huntsville”) and True40 Franchise Company LLC of any physical condition or disability that would prevent or limit my participation in an exercise or physical conditioning program. I understand that neither True40 Huntsville nor True40 Franchise Company LLC, nor their respective officers, shareholders, members, managers, or employees (including but not limited to coaches, trainers, teachers, sales associates, trainees, and contractors), are engaged in diagnosing or treating medical diseases or deficiencies.
3. I expressly assume all risks of my participation in all exercise programs conducted by True40 Huntsville and True40 Franchise Company LLC and hereby irrevocably waive, release, forever discharge, and covenant not to sue True40 Huntsville and True40 Franchise Company LLC, and each of their respective officers, shareholders, members, managers, employees, volunteers, agents, and contractors, and all other persons or entities acting for them (including but not limited to coaches, trainers, teachers, sales associates, trainees, and childcare workers) (collectively the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind or nature whatsoever, whether known or unknown, including but not limited to claims for personal injury, illness, property damage, death, or attorneys’ fees arising out of or related to (directly or indirectly) my participation in any exercise programs, conditioning programs, or any other activities, or use by me or any other individual of any equipment or machinery, at any True40 Huntsville or True40 Franchise Company LLC facility or event. I acknowledge and agree this waiver and release applies to any and all claims, causes of action, and liabilities of every kind or nature whatsoever, whether known or unknown, suspected or unsuspected, including, without limitation, claims sounding in negligence, wantonness, premises liability, or arising under any statute, in law, or in equity, and including any claim for actual, compensatory, consequential, or punitive damages.
4. I grant True40 Huntsville and True40 Franchise Company LLC, and their respective successors, assigns, licensees, and designees, the irrevocable, perpetual, royalty-free right and license to photograph, record, and otherwise capture my name, image, likeness, voice, and appearance (collectively, “Likeness”), and to use, reproduce, publish, display, distribute, edit, modify, and create derivative works from such Likeness, in any and all media now known or hereafter developed, for any lawful purpose, including without limitation advertising, marketing, promotion, and commercial use. I acknowledge and agree that I will receive no compensation for such use and that all rights, title, and interest in and to such materials shall be the sole property of True40 Huntsville and/or True40 Franchise Company LLC. I hereby waive any right to inspect or approve any use of my Likeness and release and discharge True40 Huntsville and True40 Franchise Company LLC from any and all claims, demands, or causes of action, including but not limited to claims for invasion of privacy, right of publicity, defamation, or any other personal or property rights, arising out of or relating to such use.
5. I acknowledge and agree that True40 Huntsville and True40 Franchise Company LLC are not responsible for any articles lost, stolen, or damaged in or about the studio. I understand that the storage cubbies are open to the public and do not have locks.

True40 Huntsville reserves the right, in its sole and absolute discretion, to impose, amend, and enforce any rules, policies, and restrictions regarding access to and use of its facilities, equipment, and services. I agree to abide by all such rules and acknowledge that failure to do so may result in suspension or termination of my access without refund.
Childcare Agreement and Release of Liability
This section applies only if you use True40 Huntsville's on-site childcare services.
I, on behalf of myself and as the parent or legal guardian of the child(ren) identified below, acknowledge and agree that the use of True40 Huntsville’s childcare services involves inherent risks, including but not limited to the risk of injury from play, interaction with other children, equipment, and the actions or omissions of staff or other participants. I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of True40 Huntsville or others. I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind or nature whatsoever, whether known or unknown, including but not limited to claims for personal injury, illness, property damage, death, or attorneys’ fees arising out of or relating to my child(ren)’s participation in or presence at any of True40 Huntsville's childcare services facilities. In addition:
• I understand that if my child should become inconsolable (crying for 10 continuous minutes) during the class session, I am responsible for leaving class and attending to my child.
• I understand that I must reserve a spot for my child (or each child, if more than one) at least 2 hours prior to class. If I must cancel within that window, I understand I will be charged a $15 fee.
• I will be responsible for feeding my child and having my child use the restroom prior to the start of class time, to the best of my abilities.
• I understand that while my child is on the premises of True40 Huntsville, I must always remain on the premises.
• I understand that I am responsible for communicating any allergies and/or special instructions to the True40 Huntsville team.
• I understand that children who exhibit symptoms of illness (fever of 100°F or higher within the past 24 hours, vomiting, diarrhea, unexplained rash, severe cough, or any contagious condition) may not be brought to childcare.
Acknowledgment and Signature
I have read this Client Waiver, Studio Policies, and Childcare Agreement in its entirety. I understand and voluntarily agree to be irrevocably bound by all the terms stated above as a condition of my use of or presence at any True40 Huntsville facility. I am at least 18 years of age, or I am the parent or legal guardian of a minor participant and have the authority to sign on their behalf.

7. There are no phones allowed in the studio during class. If you're expecting a call, leave your phone at the front desk and an employee can come get you during class.

Childcare Agreement + Release of Liability:
I release and hold harmless True40, DMD LLC and its owners, directors, officers, advisors, employees, agents, instructors, volunteers, childcare workers and all other persons or entities acting for them from any and all claims, demands, suits, costs and charges, in connection with or arising out of DMD LLC childcare service, including but not limited to, personal injury, bodily harm, injury or property damage occurring while the below child/children is/are in their care at DMD LLC.
I understand that if my child should become inconsolable (crying for 10 minutes) during the class session, I am responsible to leave class and attend to my child.
I understand that I must reserve a spot for my child/each child at least 60 minutes prior to class. If I have to cancel within that window, I understand I will be charged a fee to compensate staff.
I will be responsible to feed my child and have my child use the restroom prior to the start of class time to the best of my abilities.
I understand that if my child is on the property of the True 40 and DMD LLC studio, I must remain on the property at all times.
I understand that I am responsible for communicating any allergies and/or special instructions to the team at DMD LLC.
Agreement and Release of Liability
I understand and am aware that strength, flexibility and aerobic exercise, including the use of equipment, is a potentially hazardous activity. I have been advised and understand that fitness activities, including but not limited to pilates, barre exercises and suspension fitness and using suspension equipment, dumbbells and all other equipment, including but not limited to yoga mats, fitballs and TRX suspension system, involve a risk of injury, especially to people who have pre-existing injuries, illness or medical disabilities. I understand and am aware that these exercises described herein will be conducted without shoes and barefoot. I am voluntarily participating in these activities and using all the equipment, suspension equipment and machinery with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or even death.
I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation or use of all equipment, suspension equipment and machinery. I do hereby acknowledge that I have been informed that a medical evaluation is advisable before participation in an exercise/fitness activity or in the use of all exercise equipment, suspension equipment, dumbbells and machinery. I acknowledge that I have either had a physical examination and have been given my physician’s permission to participate, or that I have decided to participate in activity and use of all equipment, suspension equipment, dumbbells and machinery without the approval of my physician and do hereby assume all responsibility for my participation and activities, and utilization of all equipment and machinery in my activities. I understand it was my responsibility to fully inform ATO ENTERPRISE LLC of any physical condition or disability which would prevent or limit my participation in an exercise or physical conditioning program. I understand that True40 nor its officers, shareholders, employees, including but not limited to coaches, trainers, teachers, sales officers, trainees and contractors are engaged in diagnosing or treating medical disease or deficiencies.
I expressly assume all risks of my participation in all exercise programs conducted by ATO ENTERPRISE LLC and hereby waive, release and forever discharge any claim which might otherwise be brought against True40, its officers, shareholders and employees, including but not limited to coaches, trainers, teachers, sales officers, trainees and contractors, as a result of injuries resulting from or relating to my participation in all exercise programs, conditioning programs, in any activities, or use of all equipment, suspension equipment or machinery.
I expressly permit and allow True40 and ATO ENTERPRISE LLC, its officers, shareholders and employees, including but not limited to coaches, trainers teachers, sales officers, trainees and contractors, to use my image publicly, either photographically or videographically, images or movies, in such avenues as the True40 website, on social media, in advertising and any and all forms of marketing as seen fit by ATO ENTERPRISE LLC officers, shareholders and employees, including but not limited to coaches, trainers teachers, sales officers, trainees and contractors.
I understand that ATO ENTERPRISE LLC are not responsible for any articles lost, stolen or damaged in or about the studio. I understand that the storage cubbies are opened to the public and do not have a lock.
True40 Studio Policies:
1. Since we are a reservation-based studio, we ask that you cancel your class reservation at least 2 hours before the scheduled class time. No-shows or canceling within the 2-hour window will result in a $15 fee, or a deduction from your class pack.
2. If you're on a waitlist, it means that you plan to come to class if a spot opens up all the way up to one hour before class. Late cancel and no-show fees will apply if you're added to class from the waitlist within the time period above and don't show up.
3. Clients are required to wear sticky socks to keep studio environment clean. You can bring your own sticky socks to the studio or they are available for purchase once you arrive.
4. When you purchase a package, you are agreeing to pay the listed amount for the duration of the package, unless extreme circumstances occur. Your email is safely secure with us. You will receive reminders, notifications, our newsletter, and promotion. You have the option to unsubscribe at any time. For retail purchases, we offer exchanges and returns for store credit as long as we still have the item in stock, and item is in good condition. We do not offer refunds or returns on class packs or memberships.
